family law

When you’re going through a divorce or custody battle, the details of your case can take over your life. They may even feel too big to manage. We know what you’re up against, and we’ll help you make sense of the situation.

The legal team at Riddell, Aimar and Brehm LLC is highly experienced with family law cases varying from simple dissolution and divorce to child custody issues.

Divorce

The ending of a marriage can be an emotional time, raising many questions about the future. The attorneys at Riddell Aimar and Brehm LLC are aware of how difficult this time may be for you, and are here to make the process as stress free as possible.

Dissolution

If a couple decides that they can reach an agreement on the separation of their marriage, they will likely choose to ask the court to "dissolve" their marriage. While this is different than a divorce, the attorneys at Riddell Aimar and Brehm LLC will treat the matter with the utmost sensitivity, helping you through the process.

Child Custody

In the event of a divorce, working out a child custody and visitation agreement may prove to be challenging, especially if there is a level of hostility between you and the other parent. Whether you are just newly separating from a spouse, or have an unresolved custody battle, we can help. We understand that being able to see your child is of the highest importance, and we are willing to fight for your parental rights.

  • Common Types of Agreements

    • Physical and Legal Custody: One parent obtains "physical" custody of the child, allowing for the non-custodial parent to have visitation time.Typically, the custodial parent shares "legal" custody with the non-custodial parent, meaning that both parents share the right to make decisions for the child or children.

    • Joint Custody: In a joint custody agreement, each parent spends approximately equal time with the child or children. This type of agreement works best if the parents are able to cooperate and make joint decisions for the child.

    • Split Custody: With a split custody agreement, custody of siblings is "split" between the two parents. One parent will have custody of one or more of the children, while the other parent has custody of the other child or children.

    • Grandparent's Rights

Child Support

If you are facing a potential child support dispute because of a a divorce or being s single parent, finding a lawyer is key to resolving these kinds of issues. The lawyers at Riddell Aimar and Brehm promise to provide you with the representation that will achieve the best possible results, whether it be through the establishment of a new child support order, the enforcement of an existing order, or establishing paternity.

Alimony, Maintenance, and Spousal Support

If you earn more than your spouse, and are facing an impending divorce, you will likely be ordered to make alimony payments, known as maintenance or spousal support. Our main goal is always to ensure that you receive the best possible outcome for your case by helping you reach a favorable agreement.

Premarital and Prenuptial Agreements

Before getting married, people often want to create a prenuptial agreement, or premarital agreement. A "prenup" is a contract that lists the assets and property that each person owns, an what property they will own after marriage. These agreements allow you to prepare for any possible outcome, and we will gladly meet with you to establish the best plan to protect you and your assets.

Paternity

In today's world, not every family starts out the same way. It may be necessary to prove the identity of a child's father through DNA testing. Establishing paternity often becomes a factor in cases dealing with paternity lawsuits, child adoption, child support, custodial rights, and inheritance. We have represented both mothers and fathers in these legal issues, advocating for parental rights and the best interests of the child.

Adoption

The adoption process may seem difficult. Our experienced attorneys will guide you through the process by providing the information and representation necessary to ensure a stress-free adoption.
